These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Homeowner,” “Contractor,” or “You”) and iDzyns LLC, doing business as House Pros Now (“Company,” “we,” “us,” or “our”), concerning your access to and use of the https://houseprosnow.com website, web applications, and mobile interfaces.
By accessing, using, or registering on House Pros Now, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the platform and must discontinue use immediately.
2. Marketplace & Directory Nature
House Pros Now provides marketing exposure and software tools enabling homeowners to discover and contact independent contractors. Any contract, estimate, proposal, warranty, or agreement for physical work is entered into directly and solely between the homeowner and the independent contractor.
We do not perform construction services, and we do not supervise, manage, control, or guarantee the quality, safety, timing, or legality of any work performed by third-party pros.
3. Homeowner Terms & Quote Requests
When submitting quote inquiries or using our pro search:
- Accurate Information: You agree to provide true, accurate, and current contact information (name, phone, email, project address).
- Consent to Direct Contact: Submitting a quote request constitutes your express affirmative request to receive phone calls, text messages (SMS), or emails from up to 5 verified local service professionals regarding your specific project inquiry.
- Homeowner Verification Responsibility: While House Pros Now screens contractor profile submissions, homeowners remain solely responsible for confirming current state licenses (e.g., Arizona Registrar of Contractors), bonds, and liability insurance before signing any contract or issuing payments.
4. Contractor Listings & Licensing
Businesses, tradespeople, and contractors who create a business profile on House Pros Now represent and warrant that:
- They possess all legally required state, county, and municipal licenses and registrations required to perform their stated trades in the jurisdictions where they advertise.
- They maintain active commercial general liability insurance and workers’ compensation coverage as mandated by applicable state law.
- All profile representations, portfolio photos, customer testimonials, and pricing ranges are truthful and accurate.
- House Pros Now reserves the right, in its sole discretion, to suspend or remove any contractor profile that fails to meet quality standards, receives unaddressed consumer complaints, or allows licenses to lapse.
5. Subscriptions, Fees & Cancellations
For Homeowners: Use of House Pros Now to search directory listings and request estimates is 100% free of charge.
For Contractors: We operate on a transparent monthly subscription model (e.g., Free Starter, Pro Growth at $49/mo, Premium Growth at $149/mo). We never charge pay-per-lead markups or auction homeowner leads.
- Paid subscriptions are billed on a recurring monthly or annual basis in advance.
- Contractors may cancel subscription renewals at any time through their dashboard or by contacting support before the next billing date.
- Subscription fees are non-refundable once the billing period has commenced, except as required by law.
6. Intellectual Property & Brand Assets
Unless otherwise indicated, House Pros Now, its logos, software code, databases, website designs, audio, video, text, and graphics are the exclusive proprietary property of iDzyns LLC and are protected by United States copyright, trademark, and unfair competition laws.
You are granted a limited license to access and use the platform strictly for personal, non-commercial homeowner use or authorized contractor profile management.
7. Reviews, Ratings & Content License
Users may post reviews, photos, and ratings. By submitting content, you grant House Pros Now a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, display, and publish such content in connection with our directory operations.
We reserve the right, but have no obligation, to monitor, edit, or remove any user review that contains defamatory, profane, false, abusive, or competitor-manipulated statements.
8. Prohibited Conduct & Scraping
You agree NOT to:
- Systematically retrieve data, business phone numbers, or contractor listings from House Pros Now using automated bots, crawlers, or scrapers.
- Submit fictitious or fraudulent lead inquiries to harass contractors or test systems without genuine intent to hire.
- Attempt to bypass security measures or access restricted API endpoints.
- Use House Pros Now to solicit contractors for competing software, lead generation, or marketing directories.
9. Disclaimer of Warranties
THE HOUSE PROS NOW PLATFORM, DIRECTORY, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE DIRECTORY WILL BE UNINTERRUPTED OR ERROR-FREE, NOR DO WE MAKE ANY WARRANTY AS TO THE RESULTS, ACCURACY, TIMELINESS, OR QUALITY OF WORK PROVIDED BY ANY CONTRACTOR LISTED ON THE SITE.
10. Limitation of Liability (In Our Favor)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOUSE PROS NOW, IDZYNS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PROPERTY INJURY, CONTRACT DISPUTES, OR DEFECTIVE WORKMANSHIP ARISING FROM YOUR USE OF THE PLATFORM OR YOUR ENGAGEMENT WITH ANY LISTED CONTRACTOR.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL BE STRICTLY LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO HOUSE PROS NOW DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING, OR $50.00 USD, WHICHEVER IS LESS.
11. Indemnification
You agree to defend, indemnify, and hold harmless House Pros Now, iDzyns LLC, its parent company, subsidiaries, affiliates, and all of their respective officers, agents, partners, and employees from and against any loss, damage, liability, claim, or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of: (1) your use of the platform; (2) breach of these Terms; (3) any dispute between you and any contractor or homeowner; or (4) your violation of the rights of any third party.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or related to these Terms or the platform shall be instituted exclusively in the federal or state courts located in Maricopa County, Arizona, and each party irrevocably submits to the exclusive personal jurisdiction of such courts.
